No 'legal basis' for Higgins' TV interview
There is "no legal basis" for the prosecution to play a six-hour pre-recorded interview between Network Ten's The Project and Brittany Higgins, an ACT court has heard.
Director of Public Prosecutions Shane Drumgold told the ACT Supreme Court on Wednesday he would not be relying on the interview as evidence during the trial of the man accused of her sexual assault.
Bruce Lehrmann has pleaded not guilty to sexual intercourse without consent.
Chief Justice Lucy McCallum told the court the nature of the case would be "word against word" with both sides attempting to establish credibility points in front of the jury.
Lawyers for Lehrmann are also attempting to acquire documents from the Australian Federal Police, with the determination about what evidence will be handed over due to go into next week.
The prosecution is working to determine whether it needs to edit parts of audio evidence ahead of the trial after raising concerns about how direct some questions were put during interviews.
The questions included the prefix: "Can you offer me an explanation as to why ..."
The trial is due to begin on October 4.
