Justin Rodney Clarke jailed for domestic violence assault sparked by argument over prescription drugs

A 37-year-old Narrogin man with a long history of domestic violence has been sentenced to 13 months behind bars for an assault sparked by an argument over prescription drugs. The Albany Magistrate’s Court was told last Thursday Justin Rodney Clarke had asked his partner, a 51-year-old Narrogin woman, for some of her prescription painkillers late at night on April 14. After his partner refused, police prosecutors told the court Clarke then turned his stereo up to keep his partner awake, stating he would not give her what she wanted because she would not give him what he wanted. Clarke’s victim was forcibly pushed on to a couch, and he was charged with aggravated common assault. Prosecuting Sergeant Alan Dean initially alleged Clarke had punched his victim in the nose, before accepting the facts put forward by Clarke’s defence counsel. The assault put Clarke in breach of a suspended prison sentence, for another assault charge in August last year, and in breach of protective bail conditions and an intensive supervision order. Clarke’s lawyer told the court the victim wanted to continue the relationship and was supportive of him. The court was also told Clarke had a long history of domestic violence. Magistrate Raelene Johnston said it was not unusual for victims of domestic violence to be supportive of their abusers in the courts. “Domestic violence is not tolerated by the courts or the community. It’s despicable,” Ms Johnston said. “Violence in relationships is problematic for you. What was originally childish behaviour quickly escalated.” Clarke was previously sentenced to 10 months for the August 2018 assault, a sentence which was suspended. Another three months was added for the April assault and breaching bail conditions.
